Agreement: By accessing, using, browsing or booking through our Web Site(s) or Directly or Indirectly through Moksha India Tours or its representative(s), you agree that you have read, understood and agree to be bound by these terms and conditions and you agree to comply with all applicable laws, rules and regulations.
Prices: Prices quoted generally include accommodation charges, taxes (unless specified otherwise) and in some cases specified meals (Breakfast / Lunch / Dinner). Prices do not however include any personal expenses or additional fees such as telephone calls, items from the mini-bar, services, cleaning, etc.
Payments: For the services contracted, full/partial advance payment should be made to hold the bookings on confirmed basis and the balance amount (if any) needs to be paid before commencement of services. We hold the right to decide upon the amount to be paid as an advance payment, based on the nature of services, vendor requirements and/or the time left for the commencement of the services.
Modes of Payment: Based on the transactional requirements, payments can be made through one of the following methods:
We do not accept payments through cheque.
Overseas advance payment can be made through Bank / Wire Transfer to our bank account. The transfer/processing charges levied by the bank need to be deposited in addition to the payment amount.
For foreign travellers, upon arrival in India, the balance payment (if any) can be made through currency notes or travellers cheques or through Master / Visa / Diners / American Express Credit Card. In case of payments through a Credit Card, the bank transaction charges—as applicable—would be levied over and above the total amount.
No Show / Early Departure / Cancellation Policy: In case of cancellation of reservations and/or tour/travel services due to any avoidable/unavoidable reason(s) we must be informed in writing. Cancellation charges would be effective from the date we receive the intimation in writing and cancellation charges would be as below:
During “Peak-Season,” which is defined by the density of tourist inflow in each region, and may vary from place to place and hotel to hotel, any particular hotel may implement a different cancellation policy. The travel agent is bound to follow the hotel specific cancellation policy; and in case of variation from the above stated policy, the excess in cancellation charges will be borne by the client and not the travel agent.
In case you cancel the trip after commencement, refund would be restricted to a limited amount that too would depend on the amount that we would be able to recover from the hoteliers we patronize. For unused hotel accommodation, chartered transportation and missed meals etc. we do not take any guarantee to refund.
Modifications/Cancellations sent directly to the hotel will not be honored.
For Outbound Travel from India, Visa processing charges and fees are fully non-refundable in case of cancellation of trip and also in case of Visa denial by the respective embassy.
Refund: In regard to refund of unused /
unutilized services (which are paid for and cancelled well in
advance) the refund amount would be worked out on the basis of
cancellation policy as described above and the money would be
accordingly refunded to the person who has made the payment to
us. Any refund against a payment received through a Credit Card,
will be made on the same credit card only. Please note that the
refund process may take 2 to 8 weeks due to banking
procedures.
No deductions will be made for the refunds (except the
transaction charges), which are made due to unavailability of
services. If the services requested are unavailable during the
requested period, we will offer similar alternatives well before
the commencement of the services and if the client does not find
the alternatives acceptable, the advance will be refunded.
However, once the alternative service is accepted by the client,
cancellation of the same will be subject to the above stated
cancellation policy.
Tariffs And Taxes: Please note that after the
finalization of the tour/service cost, if there are any hikes in
entrance fees of monuments/museums, taxes, fuel cost or guide
charges, the same would be charged as extra.
Hotel
Administration reserves all rights for revision in room tariffs
until the actual check-in of the client. To confirm the
reservation(s), the payment is made in advance based on
currently applicable and published tariffs of the hotel. In an
event of hike in room tariffs, by the hotel administration, the
Travel Agent will not be liable for the additional supplement.
The client is requested to note that under such rare but
possible circumstances, the client will be liable to pay the
additional supplement as demanded due to the revision in
tariffs.
General Terms: Moksha India Tours acts only in
the capacity of agent for the hotels, airlines, transporters,
railways & contractors providing other services & all exchange
orders, receipts, contracts & tickets issued by us are issued
subject to terms & conditions under which these services are
provided by them.
The hotel ratings given on our web
sites are established by qualified local authorities and do not
reflect our opinion about the hotel or the service rendered by
the hotel.
All itineraries are sample itineraries,
intended to give you a general idea of the likely trip schedule.
Numerous factors such as weather, road conditions, the physical
ability of the participants etc. may dictate itinerary changes
either before the tour or while on the trail. We reserve the
right to change any schedule in the interest of the trip
participants’ safety, comfort & general well being.
We shall not be responsible for any delays & alterations in the
program or expenses incurred – directly or indirectly – due to
natural hazards, flight cancellations, accident, breakdown of
machinery or equipments, breakdown of transport, weather,
sickness, landslides, political closures or any untoward
incidents.
We shall not be responsible for any loss, injury or damage to
person, property, or otherwise in connection with any
accommodation, transportation or other services, resulting –
directly or indirectly – from any act of GOD, dangers, fire,
accident, breakdown in machinery or equipment, breakdown of
transport, wars, civil disturbances, strikes, riots, thefts,
pilferages, epidemics, medical or custom department regulations,
defaults, or any other causes beyond our control.
We do not have any insurance policy covering the expenses for
accident, sickness, loss due to theft, or any other reasons.
Visitors are advised to seek such insurance arrangements in
their home country. All baggage’s & personal property/s at all
times are at the client’s risk.
Complaints regarding booked services: Any
suggestions from the client will be gladly accepted in order to
improve the level of services and accommodation provided. We
welcome your feedback, comments and/or complaints regarding the
services purchased through us.
We have taken all reasonable care to make sure that all the
services are provided to a reasonable standard and are provided
as described in our Web Sites. However, Moksha India Tours is
not responsible for any changes made by the supplier of which we
have not been informed.
Moksha India Tours will not be responsible for any lapse in
services provided by third party vendors like hotels or airlines
or transporters. We take reasonable care while patronizing a
vendor; however, may not under any circumstances guarantee the
standard of services provide by the same.
E & O E – Errors and Omissions Excepted
Moksha India Tours will not be responsible for any human error
or typing error, which has gone unnoticed by the guest or the
company’s staff.
Modification of These Terms and Conditions: Moksha India Tours reserves the right to amend/modify the terms, conditions, and notices as suitable in the interest of the clients and the company; and to comply with the legal requirements governing the industry.
Legal jurisdiction: For any dispute, the Civil Court of New Delhi, India is to be acknowledged as the sole competent authority.
